1. Acceptance of Terms

By downloading, installing, or using Joy CareBot ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Joy CareBot is an AI-powered wellness companion that provides:

• Conversational AI agents for emotional wellness and companionship
• Health data monitoring through Apple HealthKit integration
• Calendar management and event reminders
• Emotion journaling and memory tracking
• Caregiver connectivity for shared health monitoring

3. Account Registration

• You must be at least 18 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration
• You are responsible for all activity that occurs under your account
• If you enable biometric authentication (Face ID or fingerprint), you are responsible for ensuring only authorized individuals have biometric access to your device

4. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App's systems or other users' data
• Interfere with or disrupt the App's services or servers
• Upload malicious content, viruses, or harmful code
• Impersonate any person or entity
• Use the App to harass, abuse, or harm others
• Reverse engineer, decompile, or disassemble any part of the App
• Share your account credentials with others

5. AI Conversations

5.1 Nature of AI

• The AI agents in the App are artificial intelligence programs, not licensed healthcare professionals, therapists, or medical doctors
• AI responses are generated by machine learning models and may occasionally be inaccurate, incomplete, or inappropriate
• The App is designed for general wellness companionship and is NOT a substitute for professional medical advice, diagnosis, or treatment

5.2 Voice Chat

• When you activate voice chat, your microphone captures audio that is transmitted to our servers for processing
• You consent to this audio capture and processing when you initiate a voice conversation
• Audio is processed in real-time for speech recognition; raw audio is not permanently stored

5.3 Content

• We do not guarantee the accuracy, completeness, or reliability of any AI-generated response
• You should not rely on the App for emergency medical situations; always call emergency services if you are in danger

6. Health Data

6.1 Not Medical Advice

• Health data displayed in the App is for informational purposes only
• The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease
• Always consult a qualified healthcare professional for medical decisions
• Health insights and trends provided by the App are based on data from your device's sensors and may not be fully accurate

6.2 HealthKit Integration

• Health data access requires your explicit permission through iOS system prompts
• You may revoke HealthKit access at any time through your device's Settings > Privacy > Health
• Background health sync runs periodically to provide up-to-date wellness insights; this may impact battery usage

6.3 Caregiver Access

• By linking a caregiver, you authorize them to view your health summaries, activity data, and alerts
• You may remove a caregiver at any time through the App
• You are responsible for ensuring you have appropriate consent before adding someone as a caregiver

7. Calendar Integration

• By linking Google Calendar or Microsoft Calendar, you authorize the App to read and create calendar events on your behalf
• Calendar access is governed by the respective provider's terms of service
• You may revoke calendar access at any time through your Google or Microsoft account settings
• Local event reminders are scheduled on your device and do not require server communication

8. Intellectual Property

• The App, including its design, code, AI models, branding, and content, is the property of Spiritify.ai
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes
• You may not copy, modify, distribute, or create derivative works based on the App
• Custom AI agents and avatars you create remain associated with your account; the underlying AI technology remains our property

9. Third-Party Services

The App integrates with third-party services including:

• Google Sign-In (governed by Google's Terms of Service)
• Apple Sign-In (governed by Apple's Terms of Service)
• Google Calendar API (governed by Google's Terms of Service)
• Microsoft Calendar API (governed by Microsoft's Terms of Service)

We are not responsible for the practices or policies of these third-party services.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, error-free, or secure
• AI responses will be accurate, complete, or appropriate
• Health data will be fully accurate or reliable
• The App will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIRITIFY.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or health information
• Reliance on AI-generated health insights
• Actions taken based on AI conversations
• Interruption of health monitoring or background sync
• Unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Spiritify.ai from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third party's rights
• Health decisions made based on App data

14. Termination

• You may stop using the App and delete your account at any time
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your right to use the App ceases immediately
• Provisions that by their nature should survive termination (disclaimers, limitation of liability, indemnification) will continue to apply

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Spiritify.ai operates, without regard to conflict of law principles.
